17. Errors in Pricing or Descriptions AS WESS Select reserves the right to unilaterally terminate a remote agreement in the event of errors or inaccuracies in the pricing or description of products on the website www.wess-parts.lv before payment for the specific product is received. Exceptions apply if the remote agreement was concluded with malicious intent, fraud, or coercion, or in cases involving defects in the ordered product, excessive losses incurred by one party, untimely payment for the product, or other cases provided by law.

18. Content Ownership Using the website www.wess-parts.lv does not grant ownership rights to the content accessible on the site. It is prohibited to use the content provided on the website without permission from the content owner or legal authorization. These Terms do not grant rights to use any trademarks or logos presented on the website. Pricing and Payment 20. Pricing All product prices listed on www.wess-parts.lv include a 21% VAT. Prices are valid for the period specified for the respective product. Delivery costs are not included in the product price.

21. Payment Methods Payment for the ordered product and chosen delivery service can be made via credit card, bank transfer, or in cash/card upon receiving the product (only at the showroom located at 123 Kārļa Ulmaņa gatve, Mārupe, Mārupe Municipality).

22. Email Requirement When placing an order, you must provide an email address to receive instructions and necessary documentation.

23. Delivery Options We offer three delivery options for ordered products: Free pickup: Collect your product at the showroom located at 123 Kārļa Ulmaņa gatve, Mārupe. Economy delivery: Receive the product at a pickup point in one of Latvia's major shopping centers via Latvijas Pasta. Comfort delivery: Have the product delivered to your address by a courier company. Delivery timelines are agreed upon during order placement.

24. Order Pickup The ordered product must be collected within three working days of notification from www.wess-parts.lv that the order is ready for pickup.

Consent to Notifications 25. Agreement to Receive Notifications By accepting these Terms, you agree to receive notifications, agreements, clarifications regarding orders, and other messages ("Notifications") via email or mobile phone. Notifications sent electronically or by regular mail are subject to the rules applicable to written communication. If you do not agree to receive notifications from www.wess-parts.lv, please discontinue using this website and its services, as WESS Select cannot provide a full range of services to users who decline such notifications.

26. Exclusion of Marketing Notifications The notifications mentioned here do not include additional marketing information, which you may choose to receive at your discretion, except when WESS Select informs clients of general promotions electronically.

Warranty Terms 27. Warranty Coverage All products purchased from www.wess-parts.lv are covered by a 2-year manufacturer’s warranty.

28. Warranty Claims Claims for defects arising during the use of a part may be submitted within the warranty period. The warranty period begins on the day the part is installed on the vehicle.

29. Warranty Exclusions The warranty does not apply to defects not caused by the Seller or Manufacturer, such as improper use, accidents, non-compliance with manufacturer installation requirements, chemical exposure, etc.

Warranty Terms

30. The following spare parts are considered wear-and-tear items and are therefore subject to a limited warranty:

• Brake discs: Thickness measurements are conducted to confirm the absence of wear. Coverage: vibration up to 30,000 km, noise up to 20,000 km.
• Wiper blades: For front and rear windshields, as well as headlights – up to 3 months/5,000 km (whichever occurs first).
• Light bulbs: 12 months.

31. Legal entities that are not classified as Consumers are only entitled to the warranty period provided by the Manufacturer.

32. Please be informed that the manufacturer’s warranty terms apply if the buyer can present the following:

• 32.1. A document proving the purchase (receipt or invoice).
• 32.2. A warranty card issued by the manufacturer or distributor (if included in the package).

33. The manufacturer’s warranty does not cover damages caused due to buyer or user fault, including but not limited to:

• 33.1. Damaged warranty seals or serial numbers on the product.
• 33.2. Product misuse or operation contrary to the instructions.
• 33.3. Scratches, broken parts, cracked screens, water damage in unintended areas, improper care, foreign objects, insects, or other signs of incorrect use.
• 33.4. Damage caused by improper power supply, non-standard telecommunications or cabling, sudden temperature fluctuations, or external factors such as soot, smoke, dust, moisture, impacts, or scratches.
• 33.5. Traces of unauthorized repairs.
• 33.6. Natural wear and tear of components.
• 33.7. Use of non-standard power supplies, accessories, or spare parts not certified by the manufacturer, resulting in product damage.
• 33.8. The warranty does not apply to additional equipment such as batteries, headphones, cables, chargers, or remote controls.
• 33.9. Use of the product for industrial or professional purposes (if not designed for such use).
• 33.10. Damage resulting from improper transportation of the product.

Right of Withdrawal

34. You are entitled to withdraw from this agreement within 14 (fourteen) days without providing a reason.

35. The right of withdrawal expires 14 days from the day you, or a third party other than your designated carrier, receive the product.

36. To exercise your right of withdrawal, you must inform us – AS WESS Select (registration number: 40003609098, address: Kārļa Ulmaņa gatve 123, Mārupe, Mārupes novads, LV-2167, email: parts@wess.lv) – of your decision to withdraw from this agreement.

37. To meet the withdrawal deadline, it is sufficient to send your notification regarding the exercise of the right of withdrawal before the withdrawal period expires.

Conditions for Exercising the Right of Withdrawal:

• 38. The product packaging must be original and undamaged. The product itself must be clean and show no signs of use.
• 39. Products returned without properly prepared documentation will be reimbursed to the Buyer at 70% of the value stated in the invoice.
• 40. The supplier will reimburse 100% of the cost of products sold in error or delayed due to the fault of WESS Select AS within 14 days of invoice issuance.

Return Policy and Terms of Compensation

41. The supplier will reimburse 100% of the cost of goods mistakenly ordered by the Client from AS WESS Select warehouses, provided no more than 14 days have passed since the invoice date.

42. The supplier does not reimburse transportation costs or additional services.

43. Products specifically ordered for the Client from BMW Group factories or warehouses are non-returnable and non-refundable.

44. The following product groups are also non-returnable:

• a. Automotive electronic components (sensors, relays, ignition coils, fuses, bulbs, etc.).
• b. Oils and lubricants (excluding transmission oils).
• c. Chemical and technical fluids.
• d. Raw materials for bicycle repair.

Products in the above categories may only be returned in exceptional cases and with prior agreement from a representative of AS WESS Select.

45. Returns are processed within 30 days of the product being delivered to the central warehouse of AS WESS Select.

46. Non-compensated goods are stored at the AS WESS Select warehouse for one calendar month from the decision date. After this period, the goods are subject to disposal.

47. Non-compensated goods may be returned to the Buyer upon request, with transportation costs added.

48. AS WESS Select reserves the right to amend the return policy by notifying the Client at least 7 days before the new rules come into effect.

49. Images of products in the online store www.wess-parts.lv may slightly differ from the actual products. For clarification or to avoid order-related confusion, contact us via email at parts@wess.lv.

50. AS WESS Select reserves the right to seek legal compensation for losses incurred due to consumer actions if the returned product's value has diminished.

Rules for Returning Core Parts and Exchangeable Goods

51. Core part returns must be submitted electronically or with a properly completed "Return Form" in written form.

52. The return request must include a filled-out and printed return form submitted to the Order Center or a properly completed written "Return Form."

53. The core part must be cleaned and packed in the manufacturer’s original packaging.

54. Reimbursement for the core part is only possible if it is identifiable, intact, and free of physical damage.

55. The core part must not show signs of corrosion, welding, rust, or mechanical damage.

56. Core part returns are processed within 20 days of the part being delivered to the AS WESS Select central warehouse.

57. Non-compensated core parts are stored at the AS WESS Select warehouse for one calendar month from the decision date. After this period, the case will be closed.

58. Non-compensated core parts may be returned to the Client upon request, with additional transportation costs applied.
